Who we are
Fitly is provided by [Company legal name], [registered address] (“Fitly”, “we”). These terms apply to shops that sign up for Fitly (“you”). Contact us at [contact email].
What Fitly provides
Fitly gives your shop a website and online store on a Fitly address (yourshop.fitly.com), a staff portal for orders, fittings, rentals, customers, stock and billing, and customer accounts on your website. Features and limits depend on your plan, as shown on our pricing page.
Your account
You must give accurate details when you sign up and keep your password safe. You are responsible for what happens under your shop’s accounts, including your team members’ accounts.
The person who creates the shop is its owner and controls its settings, team and subscription.
Free trial and subscription
Every plan starts with a 14-day free trial. No payment is taken during the trial. When the trial ends, your website and portal stop working until you subscribe.
Subscriptions are billed monthly or yearly in advance at the price shown when you subscribe. You can change plan at any time. If you cancel, your subscription stays active until the end of the period you have paid for.
If a payment fails, we may mark your subscription as past due and, if it is not paid within [number] days, suspend your shop.
Your customers and your sales
You sell to your customers directly. Prices, products, hire terms, deposits, refunds and your shop policies are between you and your customers.
Payments your customers make through payment providers (such as PayHere, KOKO or Mintpay) or by bank transfer go to you under your own agreements with those providers. Fitly is not a party to those payments.
Your content and data
You keep ownership of the content and data you put into Fitly, including your products, photos and customer records. You give us permission to store and display it only to run the service for you. Our Privacy policy explains how we handle personal data.
Acceptable use
Do not use Fitly to sell illegal goods, to send spam, or to upload content you don’t have the right to use.
Do not try to access other shops’ data or interfere with the service.
Support access
To help you, the Fitly team can open a short, logged support session in your shop portal. We only do this to investigate a problem or when you ask us to.
Availability and maintenance
We work to keep Fitly available, but we do not promise uninterrupted service. Planned maintenance is announced on your website and portal in advance where possible.
Suspension and closing your shop
We may suspend a shop that breaks these terms or does not pay. You can stop using Fitly at any time. [Describe how long data is kept after closing and how a shop can ask for a copy.]
Liability
[Limitation of liability wording to be provided by your lawyer.]
Changes to these terms
We may update these terms. If a change is significant, we will tell shop owners by email before it takes effect.
Governing law
These terms are governed by the laws of [jurisdiction].
